Terms and Conditions for Beauty Service Customers

These Terms and Conditions ("Terms") govern the access to and use of Bookly application ("App") provided by AHAJAZ LEY Company ("Company, US, OUR"). By accessing or using access our platform, including our website, mobile application, and related services (collectively, the "Services"), Beauty Service Providers ("Providers") and Customers ("Customers") agree to be bound by these Terms.

1. Eligibility

1.1. You must be at least 18 years old to register, access, or use our Services. By creating an account, you confirm that you meet this age requirement.
1.2. The Services are intended for personal use and must not be used for any unlawful or unauthorized purpose.
1.3 Only women are eligible to use the Services provided by the App, whether as a Provider or a Customer. By using the app, you confirm that you are a woman.

2. Account Registration

2.1. To access certain features of the App, you must register for an account and provide accurate and complete information.
2.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
2.3. If you suspect unauthorized use of your account, notify us immediately at Info@book-ly.com.

3. Service Providers and Bookings

3.1. The App connects Customers with third-party Providers offering beauty and wellness services.
3.2. While we strive to ensure the quality of Providers, we are not responsible for the services they provide, including their availability, professionalism, or conduct.

4. Booking and Payments

4.1 You may book appointments for services provided by Providers through the App, subject to availability.
4.2 You agree to pay the applicable fees for the booked services, including any additional charges for extras or upgrades.
4.3 Some Providers may require a deposit at the time of booking. You agree to pay the deposit for the booked services in advance, subject to Providers booking policy. Deposited amount shall be held by the App and released to the Provider after the completion of the scheduled appointment date.

5. Cancellations and Refunds

5.1 If the Provider cancels the appointment for any reason or in case of no-show by the Provider, the full deposit is refunded to the Customer to the original payment card.
5.2 In case of appointment cancellation by the Customer, refund of deposit is subject to Provider's cancellation policy.
5.3 In case of Customer no-show, the deposit is forfeited entirely.

6. User Conduct

6.1. You agree to use the Services in compliance with applicable laws and not to:
- Engage in fraudulent activities.
- Post false or misleading information.
- Interfere with the operation of the App.

7. Disclaimer and Limitation of Liability

7.1 You are solely responsible for your interactions with Providers and agree to hold the Company harmless from any disputes or claims arising from such interactions.
7.2 The Services are provided "as is" without warranties of any kind, either express or implied.
7.3 To the maximum extent permitted by law, the App is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.

8. Changes to These Terms

8.1 We may update these Terms from time to time. The updated version will be posted on the App and take effect immediately upon posting.
8.2 Your continued use of the Services after updates constitutes your acceptance of the revised Terms.

9. Termination

9.1 We reserve the right to suspend or terminate your access to the Services at our sole discretion, without prior notice, for any reason, including violation of these Terms.

10. Governing Law

10.1 These Terms are governed by and construed in accordance with the laws of Saudi Arabia.

3. Service Listings and Bookings

3.1. As a Service Provider, you are responsible for accurately describing the services you offer, including pricing, availability, and any applicable terms.
3.2. Bookings facilitated through the App are binding agreements between you and the customer.

4. Deposits and Payment

4.1. You may require a deposit for bookings through pre-defining the amount or percentage in the account settings. Deposits will be held by the App and released to you within 30 calendar days after the completion of the scheduled appointment date.
4.2 Amounts deducted from completed services through Customer using promotional codes produced by the App shall be accumulatively repaid to the related Provider's registered bank account within 30 calendar days after receiving payment of invoice with deducted amount. As an exception, amounts deducted from completed services through the Customer using promotional codes created especially for the Provider as a means of marketing shall not be repaid to the Provider unless otherwise explicitly agreed.
4.3. The App does not take commissions on transactions between Providers and Customers.

5. Subscription Plans

5.1 By subscribing to a plan offered by the App, you agree to the terms and conditions specific to that plan, including pricing, duration, and any additional features or benefits.
5.2 Subscription fees are billed in advance on a recurring basis, unless otherwise specified.
5.3 You may cancel your subscription at any time, subject to the terms of the plan and any applicable cancellation fees.
5.4 Subscription fees are non-refundable except as required by law or explicitly stated in your subscription agreement.

6. Cancellations

6.1 The Provider shall incur a penalty equivalent to 30% of the total service fees for cancellations made within 24 hours of the appointment.
6.2 The Provider shall incur a penalty equivalent to 50% of the total service fees for failing to show up without prior notice.

7. User Conduct

7.1 You agree to use the Services in compliance with applicable laws and not to:
- Provide false or misleading information about your services.
- Engage in fraudulent activities.
- Interfere with the operation of the app.
